2 · Scope

This privacy policy applies to the website 5vision.de and to all social media presences operated by 5VISION GmbH (see section 8). Separate policies may apply to the websites of our individual brands (5VISION.NEWS, 5VISION.MEDIA, 5VISION.TECH, 5VISION.SHOP).

Processing is based on the GDPR:

• Art. 6 (1) (a) GDPR — Consent.
• Art. 6 (1) (b) GDPR — Performance of a contract or pre-contractual measures.
• Art. 6 (1) (c) GDPR — Compliance with legal obligations.
• Art. 6 (1) (f) GDPR — Legitimate interests.

In addition, the German Federal Data Protection Act (BDSG) and the Telecommunications-Digital-Services-Data-Protection-Act (TDDDG) apply.

5 · Security

We implement appropriate technical and organisational measures pursuant to Art. 32 GDPR to ensure a level of security appropriate to the risk. Transmission is encrypted via TLS (visible as the https-prefix in the address bar). Server-side we apply access controls, regular updates and backup procedures.

6 · Transfer to Third Parties / Third Countries

Transfer of personal data to other recipients (e.g. processors such as our hosting provider) takes place exclusively on one of the legal bases listed in section 4 and only under appropriate data processing agreements (Art. 28 GDPR).

Transfers to third countries (outside the EU/EEA) only take place where an adequate level of protection within the meaning of Art. 44 et seq. GDPR is ensured (adequacy decision, standard contractual clauses, etc.). Visiting our social media presences (section 8) may involve a transfer of data to the USA by the respective providers.

7 · Hosting and Server Logs

Each page request causes the following data to be stored in server log files:

• IP address
• Date and time of access
• Requested URL/file and amount of data transferred
• Browser type, browser version, operating system
• Referrer URL

Legal basis: Art. 6 (1) (f) GDPR (security and stability of operations).
Retention: max. 30 days, then deletion or anonymisation — except in case of security incidents until resolved.

8 · Contact Form

When you use our contact form, we process the data you provide (name, organisation, phone, email, inquiry) solely to respond to your request.

Legal basis: Art. 6 (1) (b) GDPR (pre-contractual measures) or Art. 6 (1) (f) GDPR (legitimate interest in efficient inquiry handling).
Transmission: Messages are delivered via SMTP to our business email address. Sending is handled by our email provider (data processor).
Retention: until your inquiry has been processed. Statutory retention periods (in particular under commercial and tax law) remain unaffected.

Note: The form contains a technical honeypot field as protection against automated bot submissions. No personal data is processed — the field is only checked server-side for bot activity.

9 · Cookies and Local Storage

Without your consent we use no tracking, analytics or marketing cookies on 5vision.de. Until you have made your choice, no third-party scripts that would store cookies are loaded.

To manage your consent we use a cookie consent tool. It stores only your decision (acceptance or rejection) locally in your browser (LocalStorage, key 5v-consent) for 180 days. No data is transmitted to us or third parties. This storage is technically necessary to avoid asking you again on every visit — legal basis: Art. 6 (1) (f) GDPR in conjunction with § 25 (2) no. 2 TDDDG.

Only after your consent is Microsoft Clarity loaded. Clarity then sets its own cookies and storage entries — in particular_clck (recognising returning visitors, lifetime 1 year) and _clsk (grouping several page views into one session, lifetime 1 day). Details on the processing are given in section 10.

Should further consent-requiring services be integrated in the future (e.g. Google Analytics, embedded videos), the banner will appear with corresponding categories. Those scripts too will not be loaded before your consent.

10 · Web Analytics — Microsoft Clarity

We use Microsoft Clarity for statistical analysis of how this website is used. Clarity generates heatmaps and session replays that let us understand how visitors interact with our pages — where they click, how far they scroll, and where they may struggle. The analysis is used solely to improve usability.

Provider: Microsoft Ireland Operations Limited (EU controller), One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland — Microsoft Corporation, One Microsoft Way, Redmond, WA 98052, USA.
Data processed: mouse movements, scroll behaviour, clicks, anonymised inputs, browser and device information, truncated IP address, time on page, referrer URL.
Legal basis: Art. 6 (1) (a) GDPR (consent) in conjunction with § 25 (1) TDDDG.
Third-country transfer: Microsoft also processes data in the USA. Microsoft is certified under the EU-US Data Privacy Framework (adequacy decision of the EU Commission of 10 July 2023); EU Standard Contractual Clauses additionally apply.
Retention: according to Microsoft, up to 1 year.

Clarity is loaded only with your consent via our cookie banner. Without consent, the script is not executed and no data is transmitted to Microsoft. You can withdraw your consent at any time with effect for the future — via theCookie Settings link in the page footer. The cookie banner will then reappear so you can make a new choice.

11 · Social Media Presences

We maintain profiles on the social networks listed below to communicate with users active there and to provide information about us. When you visit these profiles, data is collected and processed by the platform operators. We have no influence over this. Cookies are typically set, usage profiles created, and data may be transferred to third countries (in particular the USA).

Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in public presence and communication). Where consent has been given to the platform operator, additionally Art. 6 (1) (a) GDPR.

We recommend exercising data subject rights (access, deletion, etc.) directly with the respective platform provider, as only they have full access to user data.

12 · Embedded Third-Party Content

Web fonts (Ubuntu, Source Sans 3) are served locally from our own server. No third-party sources such as Google Fonts, Google Maps, YouTube videos or similar are embedded on this website.

Should this change, prior consent (two-click solution) will be obtained and this policy updated accordingly.

13 · Data Subject Rights

You have the following rights under the GDPR:

• Erasure and restriction of processing (Art. 17, 18 GDPR)
